Infrastructure Projects and PPPs

MMC’s lawyers are at the forefront of shaping the emerging area of Public Private Partnerships and Independent Project Developments, which are growing rapidly in the East African Region, especially in the transport and energy sectors.

Governments and private individuals are keen to tap private sector financing and technical expertise to Design, Build and Finance, Purchase and Lease Back, Design, Build, Finance, Operate and Maintain major infrastructure and energy facilities.

MMC is deeply involved in the development of innovative structures to facilitate the collaboration between the public and private sectors.

Our team members’ notable projects:

  • MMC is currently acting as the lead transactional advisor advising Kenya Airports Authority (KAA) on a privately initiated investment proposal (PIIP) from Kenya Airways (KQ) pursuant to which KQ is proposing to have KAA concession the operations and management of the Jomo Kenyatta International Airport. If implemented, this will be the first airport concession in the region.
  • MMC is part of the consortium that is currently advising on the development, operation and maintenance of a 300-bed private hospital by Kenyatta National Hospital, the largest national referral, teaching and research hospital in East Africa to be undertaken as the first health sector PPP in Kenya.
  • Advised an international firm interested in undertaking the construction of the Nyali Bridge (under a PPP model) on all legal aspects of PPP projects in Kenya.
  • MMC is part of the consortium advising the Kenya Railways Corporation on the legal and regulatory framework governing railways and metropolitan railway operations in Kenya which was aimed at assisting the Kenya Railways Corporation in the design of the Mass Rapid Transport System for the Nairobi Metropolitan Area.
  • Currently advising Moi University in undertaking the development, operation and maintenance of 15,000 bed-capacity students’ hostels to be undertaken under a PPP model.
  • Currently advising the University of Embu in undertaking the development, operation and maintenance of 4,000 bed-capacity students’ hostels to be undertaken under a PPP model.
  • Currently advising South Eastern Kenya University in undertaking the development, operation and maintenance of 5,400 bed-capacity students’ hostels to be undertaken under a PPP model.
  • Currently advising Kenya Technical Trainers College in undertaking the development, operation and maintenance of 4,500 bed-capacity students’ hostels to be undertaken under a PPP model.
  • Currently advising Egerton University in undertaking the development, operation and maintenance of 6,000 bed-capacity students’ hostels to be undertaken under a PPP model.
  • MMC advised the University of Nairobi’s commercial arm, University of Nairobi Enterprises and Services (UNES) Limited, in structuring a proposed public private partnership for the development of a hotel, conference centre, mall and serviced apartments on a prime seven acres a parcel of land in the heart of Nairobi. 
  • MMC has advised a consortium that was negotiating option agreements for a proposed mixed-use development on about 3,000 acres in Arusha, Tanzania. The mandate included legal structuring of the proposed mixed-use development that sought to convert coffee estates on the outskirts of Arusha into the new commercial central business district of Arusha, and that would involve elements of public private partnerships on the development of a ring road for the greater Arusha area and development of a power plant to run on natural gas.
